1. Agreement
These Terms of Use (“Terms”) are an agreement between you and Sharath Kammari, an individual developer based in Texas, USA (“we”, “us”, “our”), the developer of the GenAI Studio app for iPhone and iPad and of this website (together, the “Service”). By downloading, installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Apple’s Standard EULA
The app is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”), which is incorporated into these Terms by reference. These Terms are supplemental terms that add to the Standard EULA. If anything in these Terms conflicts with the Standard EULA, the Standard EULA governs to the extent of the conflict.
3. Eligibility and your account
- You must be at least 18 years old to use the Service. The app can generate unrestricted content from open-ended prompts and is not intended for children.
- You need an account — an email address and password, Sign in with Apple, or Google — to use the Service. Give accurate information and keep your sign-in secure; you are responsible for activity under your account.
- Tell us promptly at sharathck3@gmail.com if you believe your account has been used without your permission.
4. Subscription and free trial
The app is a free download and requires the GenAI Studio Monthly auto-renewable subscription, priced at US$1.00 per month (or the price shown in the App Store for your country or region). The subscription gives you access to the app; what you generate is paid from your credit balance (section 5).
- Free trial. New subscribers receive a one-week free trial. Trial eligibility is determined by Apple.
- Payment. Payment is charged to your Apple Account at confirmation of purchase, after the free trial ends.
- Auto-renewal. The subscription renews automatically each month unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Manage or cancel in Settings › [your name] › Subscriptions on your device. Deleting the app or your account does not cancel your subscription.
- Forfeited trial time. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.
- Price changes. If the price changes, Apple will notify you as required and, where required, ask for your consent before the new price applies.
5. Credits
- What credit pays for. Generations — text answers, images, video and audio — are paid from a credit balance in your account. The amount a generation uses depends on the model and the kind of output, and can change as providers change their prices. A generation that needs more credit than you have will not run until you add credit.
- Starting credit. New accounts start with US$2 of credit.
- Buying credit. You can buy more credit in the app as a consumable In-App Purchase (the GenAI Studio Credit Pack, which adds US$5 of credit; the price is shown in the app in your local currency), billed by Apple.
- No expiry. Credit never expires.
- No transfer, no cash value. Credit can only be used in the Service. It cannot be transferred to another account or exchanged for cash.
- Account deletion. Any remaining credit is forfeited when your account is deleted.
- Refunds for credit purchases are handled only by Apple, at reportaproblem.apple.com, except where the law requires otherwise.
6. License
Subject to these Terms and the Standard EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, for your personal or internal business use. All rights not expressly granted are reserved.
7. Your content and outputs
- You own what you put in and what you get out. As between you and us, you own your prompts, attachments and other input, and the text, images, audio and video generated for you (“Outputs”), subject to the terms of the AI provider that produced them and to applicable law.
- You give us a limited license to host, store, copy, transmit and process your input and Outputs only as needed to operate the Service for you — for example, to send your prompt to the models you pick and to keep your history on your devices.
- Outputs may not be unique. Other users may receive similar output from the same models, and you do not gain rights in their output.
- You are responsible for your input and for having the right to use it, and for how you use Outputs — including checking that your use does not infringe anyone else’s rights.
8. AI output
AI output may be inaccurate, incomplete, out of date or offensive. Models can state things confidently that are wrong, misread attachments, mishear dictation, and produce different answers to the same question. Verify important information before you rely on it.
- AI output is not professional advice (medical, legal, financial or otherwise) and must not be relied on where a mistake could cause harm.
- Output reflects the models that produced it, not our views.
- Voice features. Use live voice conversations and read-aloud only where it is safe and lawful. Do not interact with your screen while driving.
- Your requests are sent to AI providers only after you agree in the app, and you can withdraw that agreement in Settings › Privacy & AI (see the Privacy Policy).
9. Third-party AI providers
The Service relies on models and services from third parties, including OpenAI, Google, Anthropic, Microsoft Azure, xAI, Meta, Perplexity and Novita AI, and on infrastructure from Google Firebase and Google Cloud. Their availability, behavior and pricing are outside our control. We may add, change or remove providers, models, voices or features at any time, and a feature may be temporarily unavailable when a provider is. Your use of those models through the app must also follow the providers’ usage policies.
10. Acceptable use
You agree not to:
- use the Service to create, request or share anything illegal — including content that sexually exploits minors, promotes violence or terrorism, or infringes someone else’s intellectual property or privacy;
- use the Service to harass, threaten, bully, defame or impersonate anyone, or to create deceptive content about a real person without their consent;
- try to extract, copy or misuse the Service’s access to AI providers — for example by reverse engineering the app to obtain its credentials, sending requests outside the app, reselling access, or using automated means to generate in bulk;
- try to get around the Service’s billing, credit or safety measures, or those of the AI providers;
- access or try to access anyone else’s account or data, or probe, scan or test the Service’s security without our written permission;
- interfere with or overload the Service, or upload malware;
- reverse engineer, decompile or disassemble the app, except where the law expressly permits it despite this restriction.
We may remove content, limit use, or suspend an account that breaks these rules or threatens the Service or other people.
11. Availability and changes
We work to keep the Service reliable, but it may be interrupted, changed or discontinued, in whole or in part, at any time. We may update the app to fix problems, add or remove features, change the models on offer, or comply with the law. The Service needs a network connection and a compatible device and operating system version.
12. Intellectual property
The Service, including its software, design, text and graphics (but not your input or Outputs), is owned by us or our licensors and is protected by intellectual-property laws. Model and company names belong to their owners. If you send us feedback or suggestions, we may use them without any obligation to you.
13. Disclaimers
To the maximum extent permitted by law, the Service and all Outputs are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Service will be uninterrupted, error-free or secure, that Outputs will be accurate, lawful or suitable for your purpose, or that data will never be lost.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
14. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or relating to the Service or any Output, even if we have been advised of the possibility of such damages. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid for the subscription and credit in the 12 months before the claim arose, or US$10.
Nothing in these Terms limits liability that cannot be limited by law, including your mandatory rights as a consumer where you live.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Service, your input, your use of Outputs, or your violation of these Terms or of anyone else’s rights.
16. Termination
- You can stop using the Service at any time, and delete your account and its data in the app: Settings › Delete account. Remaining credit is forfeited.
- We may suspend or end your access if you materially breach these Terms, if required by law, or to protect the Service or other people. Where reasonable, we will tell you first. If we end your access for a material breach, remaining credit is forfeited to the extent the law allows.
- Ending your account does not cancel your Apple subscription — cancel it in Settings › [your name] › Subscriptions.
- Sections that by their nature should survive termination (such as Your content and outputs, Disclaimers, Limitation of liability, Indemnity and Governing law) survive.
17. Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Texas, and you and we consent to their jurisdiction. If you are a consumer living in the European Union, the United Kingdom or another country that gives you the right to bring claims in your local courts or under your local law, nothing in this section takes that right away. Before filing a claim, please contact us — most problems can be solved quickly.
18. Apple as third-party beneficiary
These Terms are between you and us, not with Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any product claims, intellectual-property claims or other claims relating to the app or your possession or use of it. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you as a third-party beneficiary.
19. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date and, if a change is material, tell you in the app before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
